                                                               Terms and Conditions 

For the purpose of this agreement: “The Photographer” is Spoon and Fork Food Photography, Hampshire England.

 

“The Client “ is the purchaser of Spoon and Fork Food Photography services and has entered into a contract of services for goods. “Images” are any images produced by the photographer in both digital and printed media.

 

Bookings

Upon booking the services of Spoon and Fork food photography the client is required to complete a booking form and pay a non refundable 50% deposit to confirm the booking. If the deposit is not paid your booking will be canceled and you will be liable for any costs incurred.

Payment Terms

The client is responsible for paying a deposit of 50% of the total invoiced photoshoot at the time of booking to secure the date in the calendar. This fee is non refundable unless the photoshoot has been cancelled by the photographer only. No photoshoot will go ahead without the deposit paid. An invoice will be sent detailing fees. The full payment of services provided by the photographer (remaining session cost and travel cost) is required to be paid within 5 days after the photoshoot. Images will not be sent unless payment has been made. PricesAll prices shown within the Photographer’s price list are subject to change without prior notice.

 

Cancellation Fees

 

If a booking is cancelled by the Client within one working day of the starting time, the Photographer reserves the right to charge the full fee for the assignment. If a booking is cancelled within two working days of the starting time, the Photographer may charge 50% of their fee. In such instances, the Photographer may charge in full for their expenses (e.g. including but not limited to; hire of specialist equipment, props) that may have incurred prior or during the assignment taking place.The photographer may make additional charges should a photoshoot overrun which is beyond the control of the Photographer ( e.g. including but not limited to; the Client requesting additional photographs over and above the Client’s original brief etc).Client

 

Confidentiality

The Photographer acknowledges that in the performances of the services, they may receive information from the Client which is designated by the Client as confidential. Upon request from the Client, the Photographer agrees to keep this information secret and not to disclose such information to other parties except as required by law.

 

Conduct

 

The Client will be responsible for the behaviour of any persons accompanying them for the photoshoot. The Photographer reserves the right to terminate any photoshoot without notice if they deem the Clients behaviour to be unruly or unsafe. In such instances, the Photographer reserves the right to charge full fees and expenses as described in these Terms and Conditions. The Client will fully reimburse the Photographer for any loss/damage they cause to property or equipment.

The photographer cannot be held responsible for any images deemed unsatisfactory if the client has directed elements of the shoot not recommended by the photographer. This includes location, final image choice, time of shoot and other variables.

 

Copyright and Ownership of Materials

 

In accordance with the Copyright, Designs & Patents Act 1988 the entire copyright of all the images captured on the photoshoot will remain the property of the photographer at all times, throughout the world. Further action will be taken if copyright has been breached. Usage rights All Images are to be used as agreed during the initial consultation at the time of booking services and upon signing of the contract. The licence to use is limited to usage by the client only and not be loaned, transferred or given to any third parties. The photographer retains the right in all cases to use images covered by this agreement for advertising and promotion of services provided by Spoon and Fork Food Photography.

 

Manipulation of images

 

Manipulation of the Images or use of only a portion of Image may only take place with the permission of the Photographer.​

 Editing and delivery of images.

 

The photographer will endeavour to edit and send via an online gallery the images captured during the photoshoot 5 working days after the photoshoot. The photographer will not be liable for delays that are beyond their responsible control. If the client requires a rush service of the images to be returned before the 5 working days allocated the client can request this and an additional charge will be made. This service is subject to availability and not a guarantee.  

 

The Photographer reserves the right to amend these Terms and Conditions without prior notice.
